The brother of a man accused of murder broke down on the witness stand on Friday as he testified to trying to persuade the man to turn himself in to the police. Thomas Capano, 49, is accused of killing Anne Marie Fahey, a secretary for the Governor, in 1996, and dumping her body at sea. Prosecutors say he killed Ms. Fahey because she wanted to end their affair. His younger brother, Louis Capano Jr., testified for the prosecution.

The trial was stopped briefly on Friday when Louis Capano began crying as he recalled two occasions in which he said he had tried to get his brother Thomas to tell the authorities the truth for the sake of the family. At the second meeting, he said, both he and another brother, Gerard, told Thomas Capano to go to the police or they would. Gerard Capano says he was with Thomas Capano when he dumped a body in the Atlantic Ocean on June 28, 1996. Louis Capano did not go to the police then, he said, because 'Tom convinced us not to and told me if the situation was reversed, he'd do the same for me.' Eugene Maurer, a lawyer for Thomas Capano, attacked the different versions of events that Louis Capano gave to prosecutors, including lies he admitted telling to a grand jury before reaching a deal to testify against his brother. Maurer also got Louis Capano to acknowledge that his brother Gerard had an unreliable memory if he had been drinking or using drugs - a key to Thomas Capano's defense against the first-degree murder charge.

Louis Capano said his brother Thomas called him on June 30, 1996, and told him that Ms. Fahey was missing. He said Thomas Capano had told him that she would probably return to work on Monday, but that she had tried to cut her wrists on his sofa on the previous Thursday and he wanted to get rid of the sofa.
